2. Purpose and scope.
These General Terms of Contract and Use regulate the provision of the information supplied in the SBFS school and online shop and the commercial transactions arising between SBFS and users of the domain www.saviabrutaflowerschool.com. Both browsing the school and online shop and purchasing any of the products offered there imply acceptance as a user, without reservation of any kind, of each and every one of these general terms of contract and use. SBFS may modify the website to make any changes and modifications it considers appropriate and necessary for its proper functioning, without prior notice.
3. Information provided on the website.
We make every effort to provide the information on the site truthfully and without typographical errors. All contractual information on www.saviabrutaflowerschool.com is shown in Spanish (Castilian), and communication with customers and users, as well as the formalisation of the contract, will take place in that language.
However, we can answer enquiries in any other language.
4. Intellectual and industrial property.
All content published on the school's site, and especially the photographs, designs, texts, graphics, logos, icons and buttons, as well as the software, trade names, trademarks or industrial designs and any other signs that may be used industrially and commercially, are subject to intellectual and industrial property rights of SBFS or of third-party owners who have duly authorised their inclusion on the website.
In no case will it be understood that any licence is granted or that there is any waiver, transfer or total or partial assignment of these rights, nor is any right or expectation of right conferred, in particular to alter, exploit, reproduce, distribute or publicly communicate this content without the prior express authorisation of SBFS or the corresponding owners.
The use of the SBFS website for public or commercial purposes is therefore prohibited, so the content of the website may not be exploited, reproduced, distributed, modified, publicly communicated, assigned, transformed or used. The inclusion of hyperlinks for commercial purposes on websites unrelated to SBFS that allow access to our website is expressly prohibited without prior consent.
Access to the website is voluntary and, therefore, the responsibility of the user, who will be responsible for any direct or indirect effect arising from their use of the website or telephone service, including, by way of example and without limitation, any adverse economic, technical and/or legal result, as well as the failure to meet the expectations generated by our website, the user undertaking to hold SBFS harmless from any claims arising directly or indirectly from such events.
SBFS is not responsible for any damage that may arise from interference, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operation of this electronic system or in users' devices and computer equipment, caused by reasons beyond the control of SBFS, that prevent or delay the provision of services or browsing of the website, nor for delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems, nor for the impossibility of providing the service or allowing access for reasons not attributable to SBFS, due to the user, third parties or force majeure. SBFS does not, as a general rule, control the use that users make of the website.
In particular, SBFS is in no case responsible for ensuring that users use the website in accordance with the law, these General Terms, generally accepted morals and good customs and public order, nor that they do so diligently and prudently.
5. Obligations of customers and users.
In general, the user undertakes to comply with these general terms, as well as with the special warnings or instructions for use contained in them and on the website, and always to act in accordance with the law, good customs and the requirements of good faith, using due diligence, and refraining from using the website in any way that may prevent, damage or impair its normal operation, or the property or rights of SBFS, its suppliers, other users or, in general, any third party.
Access to and use of the portal by minors without the express consent of their parents is prohibited; SBFS is not responsible for the truthfulness and accuracy of the data entered by the user and therefore cannot verify their age. Specifically, and without this implying any restriction on the previous paragraph, while using the website www.saviabrutaflowerschool.com the user undertakes to:
a) Provide truthful information in the data requested in the user registration or order form, and keep it up to date.
b) Not introduce, store or disseminate on or from the website any information or material that is defamatory, insulting, obscene, threatening, xenophobic, incites violence or discrimination on grounds of race, sex, ideology or religion, or that in any way offends morals, public order, fundamental rights, public freedoms, the honour, privacy or image of third parties and, in general, current regulations.
c) Not introduce, store or disseminate through the shop's site any program, data, virus, code or any other electronic or physical device that may cause damage to the website, any of the services, or any of the equipment, systems or networks of SBFS, any other user, SBFS's suppliers or, in general, any third party.
d) Diligently keep the "username" and "password" provided by SBFS, assuming responsibility for any damage that may arise from their improper use.
e) Not carry out advertising or commercial exploitation activities through the website, and not use its content and information to send advertising or messages for any other commercial purpose, or to collect or store personal data of third parties.
f) Not use false identities or impersonate others when using the website or any of its services, including, where applicable, using third parties' passwords or access codes or in any other way. Such access may only be used exclusively by the user.
g) Not destroy, alter, use for their own purposes, disable or damage the data, information, programs or electronic documents of SBFS, its suppliers or third parties.
h) Not introduce, store or disseminate through the website any content that infringes intellectual or industrial property rights or trade secrets of third parties, nor, in general, any content which, in accordance with the law, they do not have the right to make available to third parties.
Important: The customer undertakes to make delivery of the order possible by providing their phone number, a postal delivery address and an email address where the order can be delivered within normal delivery hours. If the customer fails to comply with this obligation, SBFS will have no responsibility for any delay in or impossibility of delivering the order.
6. Communication and security.
Our secure server guarantees the privacy of the data you send us. This privacy is achieved through the SSL protocol, encrypting the data sent using the RSA encryption system, so that no one can take possession of it as they do not have the necessary key.
7. Sales and booking policy
The courses and products sold through the website are paid through our payment gateway, by credit card or PayPal.
Booking a place:
— Floral Design Program, in any of its editions: the place is booked with a registration fee of €600. The remaining amount is paid no later than 7 days before the course starts.
— Masters and Master Classes: the place is booked with a registration fee of €300. The remaining amount is paid no later than 7 days before the course starts.
— Beginner workshops and one-day courses: paid in full at the time of booking.
Paying the remaining amount in instalments is possible in certain cases. The conditions are agreed individually with each student before registration is formalised and are set out in writing.
The registration fee is the enrolment fee referred to in section 11 of these terms: it confirms the place and holds it against other requests, and it is non-refundable once the legal withdrawal period of 14 calendar days has passed.
Savia Bruta Flower School undertakes to teach the course on the scheduled date, unless the course does not reach the minimum number of students and is cancelled by the school.
TERMS AND CONDITIONS FOR IN-PERSON AND ONLINE CLASSES.
Requirements
Due to the tools we use at the school, attendees must meet the following requirements:
The minimum age is 18.
It is important to wear comfortable clothes and closed shoes.
Students are expected to behave correctly and respectfully towards the instructor and/or designer during classes. If not, the student will be warned. If they do not meet the expected standards of conduct, we reserve the right to cancel their enrolment without a refund.
Language
Courses and workshops are taught in Spanish. They can also be taught in English if agreed with the school in advance, before registration is formalised.
Photographs and videos
During the courses we take photographs and videos of the work created and, on occasion, of the students, to publish on our website and social media.
Publishing images in which you can be identified requires your prior and express consent, which we will ask you for in writing on the first day of the course. You may decline, or withdraw it at any time by writing to hola@saviabrutaflowerschool.com, without this affecting your participation in the course in any way.
Payment policy
The full amount of the Floral Design Program must be paid no later than 7 days before the course starts, in any of its editions. The same applies to masters and master classes.
Courses are published in euros (€) and are paid in that currency. Prices include VAT. For cancellations and refunds, see section 11.
Force majeure events
Savia Bruta Flower School is not responsible for force majeure events that prevent all or part of its courses from taking place. This includes strikes of all kinds, terrorist acts, wars, rebellions, looting, theft, fires, earthquakes, storms, floods, natural disasters, air or other accidents, general power, water and internet outages, faults in heating and air-conditioning equipment, disease outbreaks, epidemics and pandemics, disruptions on public roads that prevent access to the school, and government, regional and Community of Madrid regulations, among others.
11. Cancellation/refund policy
Cancellation by the Student
You have 14 calendar days from the date of purchase to withdraw, in accordance with the applicable consumer legislation. After that period there will be no right to a refund, except for duly justified force majeure reasons —illness or death.
After the withdrawal period, the registration fee is non-refundable, as the place is held and is no longer offered to other people.
Online courses cannot be refunded once purchased.
Please note that refunds may take up to three weeks to process.
Cancellations by SBFS
a. Please note that courses have a minimum attendance level and may be cancelled if few bookings are received. We reserve the right to modify or cancel courses.
b. The registration fee paid is not refunded if the reason for cancellation is events beyond the control of SBFS, namely strikes of all kinds, terrorist acts, wars, rebellions, looting, theft, fires, earthquakes, storms, floods, natural disasters, air or other accidents, general power, water and internet outages, faults in heating and air-conditioning equipment, disease outbreaks, epidemics and pandemics, disruptions on public roads that prevent access to the school, and government, regional and Community of Madrid regulations, among others.
c. If we cancel a course, we will try to notify you at least one week in advance. You will have the option of changing course, or requesting a refund of the amount.
d. We will not be responsible for any loss (including, but not limited to, travel and accommodation costs) arising as a result of any modification or cancellation of the courses or of the schedule limitations set out above, beyond the cost of the course fee.
NON-ATTENDANCE
If you cannot attend one or more classes due to illness or for personal or professional reasons, you will not be entitled to a refund, an extra enrolment or an automatic transfer to another course. However, we will consider such action fair and reasonable.
Please note that if alternative options are offered, there may be an additional charge.
SUBSCRIPTIONS OR INSTALMENT PAYMENTS
Once the first payment of a subscription or instalment plan has been made and the 14 days established by law have passed, it can no longer be cancelled, and full payment may be demanded.
12. El Club by Savia Bruta Flower School
El Club is a subscription service that gives access to the school's video library through the website. It is available in two plans:
— El Club: €15 a month or €150 a year. Access to the entire video library and to the new classes published while the subscription is active.
— El Club Premium: €25 a month or €240 a year. All of the above plus the complete Floral Design Program recorded in 2021. No certificate and no feedback on work.
Customer account. To access the content you need to create an account with your email address. Login details are personal and non-transferable.
Renewal and cancellation. The subscription renews automatically at the end of each period —monthly or yearly— for the same amount, until you cancel it. You can cancel it at any time from your account; the cancellation takes effect at the end of the period already paid, during which you keep access. Amounts for periods already started are not refunded.
Use of the content. The content is for personal use. It may not be downloaded, copied, redistributed, shown in public, nor may login details be shared. Failure to comply allows the school to cancel the subscription without a refund.
Withdrawal. By subscribing you request immediate access to the digital content and acknowledge that, once that access has begun, the 14-day right of withdrawal for the current period no longer applies.
Price changes. Any change in the subscription price will be communicated at least 30 days in advance and will not affect the period already paid.
Availability. The school may modify or withdraw specific classes from the library, while maintaining the service as a whole.
