3. Data of recipients of flower deliveries
When using the Services, the customer/user must provide us with personal data of the recipients of the flowers and other deliveries they order from us ("Third-Party Data"). The customer/user is solely responsible for this Third-Party Data, as "Data Controller", insofar as such processing is regulated by the GDPR and its implementing regulations. Through the Website, the Company provides a delivery service that includes processing this Third-Party Data on behalf of the customer, the Company acting as "Data Processor" (for the purposes of providing the Service).
Insofar as the Company is a "Data Processor", it undertakes to (a) implement technical and organisational measures to safeguard Third-Party Data against any unauthorised or unlawful access, loss, destruction, theft, use or disclosure; (b) limit access to Third-Party Data only to those employees and third-party suppliers who need to know it to allow the Company to provide the Services in order to fulfil the contract with the Company (in particular the delivery and courier companies that work with the Company); (c) process only the personal data specified in this Policy in accordance with the instructions provided by the user, which include the User Account settings and their instructions (orders on the Website), and (d) not use Third-Party Data for purposes other than those related to providing the Services or in accordance with these instructions.
The user/customer guarantees that they are authorised to provide us with this Third-Party Data and will indemnify us against any damage or loss (including fines and penalties) in respect of the processing of this data while providing our services.
Except as indicated (for delivery purposes), we will not disclose Third-Party Data to any third party without the prior written consent of the user or the Third Party concerned.
On expiry or termination of the Service, because the User Account is closed, or at the express request of the customer/user, the Company will stop processing any Third-Party Data associated with their account and will delete it, as indicated in the Terms of Use. Notwithstanding the above, if the Third Party has an account with us, their Data will continue to be processed by the Company in providing the Service to that new user.
4. Users' rights
OPT OUT
How to opt out of our messages
To unsubscribe from any future promotional messages from us, you must send us an unsubscribe request to hola@saviabrutaflowerschool.com. If you do not want your personal data to be shared with third parties so that they can use that information for direct marketing purposes, you can opt out of such disclosure by emailing hola@saviabrutaflowerschool.com. We will deal with your request within a reasonable time after receiving it. Please note that if you choose to unsubscribe or not to receive communications from third parties, certain parts of the website may no longer be available to you. Under data protection laws in relation to your personal data, you have the right to:
– Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are processing it lawfully.
– Request correction of the personal data we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
– Request erasure (deletion) of your personal data. This enables you to ask us to delete your personal data where there is no good reason for us to continue processing it. You also have the right to ask us to delete your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Please note, however, that we may not always be able to comply with your request for erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
– Object to the processing of your personal data where, even though there is a legitimate interest (ours or a third party's), there is something about your particular situation that makes you want to object to processing on this ground, as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
– Request restriction of the processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it, to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
– Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially gave us consent to use, or where we used the information to perform a contract with you.
– Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
Any request must be sent to Calle Eduardo Marquina 32, 3.º, postcode 28019, Madrid, or made by phone or by email to hola@saviabrutaflowerschool.com. This right extends to Third-Party Data, insofar as we hold their data in our systems. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

7. Commercial communications
In addition to the above, in compliance with article 21 of the LSSI (Spanish Information Society Services Act), we inform you that where there is a prior contractual relationship, the email address provided by the user may be used to send commercial communications relating to products or services similar to those initially contracted by the customer.
You can object to receiving commercial communications both when making the purchase and in each of the commercial communications sent to you, all free of charge.
By objecting, the user indicates that they do not consent to their personal data being processed and communicated for commercial and advertising purposes regarding products, services, offers and promotions relating to products similar to those contracted; carrying out surveys, statistics and market trend analysis; and building User profiles in order to personalise and improve the service of Savia Bruta Flower School S.L.

You can cancel the subscription at any time from your account and request the deletion of your data by writing to hola@saviabrutaflowerschool.com.
9. Payments
Payments are processed through Stripe and PayPal, which act as data processors on behalf of Savia Bruta Flower School. The school never stores your full card details: they are handled directly by the payment gateway, in accordance with its own privacy policies and industry security standards.
